What do Paul Wayne Bergrin, Esq. and Eliot Spitzer, Esq. both have in common? Without question, both were state prosecutors, both were federal prosecutors as U.S. Attorneys within our DOJ, and both had a long history of financial transactions with organized crime ... including at a minimum prostitution rings. An arguable difference is in murder charges. Paul W. Bergrin is facing a murder charge in connection with the killing of a witness against one of his former drug dealing clients. There have been no public charges of murder against Eliot Spitzer, though there was the purported suicide of a retired state trooper who had been on official duty during the time when Eliot Spitzer was using taxpayer dollars to travel across state lines and meet with prostitutes. (see the Mann Act). But then again, there have not been any charges to date against Eliot Spitzer, notwithstanding irrefutable evidence of solicitation, Mann Act, and money laundering violations in connection with his prostitution ring involvement. Unfortunately for Mr. Bergrin, the major difference is the half billion dollar (plus or minus) Spitzer Family fortune which has always been the defining (and defending) characterstic which molded and enabled the anomalous oxymoron of public service and corruption we sadly know as "Eliot Spitzer". In any event, Mr. Bergrin's loss is a gain for truth and justice... Even a former U.S. Attorney can get indicted for his role in running a Prostitution Ring. "Smoking Gun", anyone? Here is a U.S. government lawyer using tax dollars to persuade (successfully of course) a federal judge that crimes by a connected bankruptcy lawyer should be hidden. Read below an excerpt from the document which sought to cover up the misconduct. Ummm... Kelly... We just have to nicely let you know that is this like really, really, really totally smells bad on you. Maybe you wanna go ahead and freshen, girl. Maybe even cut a deal or something...See how the corrupt government lawyers' motion to hide the eToys crime allegations, sworn by Laser Haas, plainly sidesteps truth and justice. Read this treasonous use of taxpayer funds not just for what it says, but for what it doesn't say. It doesn't say that any of the allegations written and sworn by Mr. Haas are false. Perhaps the most striking similarity between Bankruptcy Courts and Surrogate Courts is the fundamental existence of Agency Conflict. Agency Conflict in the context of estates, such as in bankruptcies and wills, as well as certain special purpose liquidating entities, is also known as the "Headless Fee Pot" problem. This problem exists when you have "a pot of money" with nobody in charge except person(s) who "earn" fees from the pot. There is a perverse incentive for such person(s) who are in effective control of the pot to ignore their fundamental duties and instead act to enrich themselves from the Fee Pot. Otherwise honest lawyers who may genuinely believe that ethics rules are not being violated easily succumb to feeding off the Fee Pot. Worse still is when organized crime grabs hold of a Fee Pot. Criminals, who also happen to be members of a State Bar, have no limiting morals and become emboldened by the special powers granted attorneys above and beyond normal citizens. Conflict Of Interest - the most common theme we find in bankruptcy misconduct. It is not surprising that in a bankruptcy case there will be people who are not happy with the outcome. Quid Pro Quo - a latin phrase that means "something for something" or "a favor for a favor". Quid Pro Quo is also a legal term which describes the payment of a bribe. When one party offers some sort of payment of money, goods, or services in exchange for something else. For example, a college professor might pass a student if she submits to sexual advances. Another example of illicit Quid Pro Quo is when a zoning board official votes in favor of a zoning change to support real estate developer's new building, in exchange for money and prostitution services. Quid Pro Quo : a business model for law firms specializing in the bankruptcy industry. Consider that a good portion of large corporations that file for bankruptcy may have engaged in illegal acts leading up to the bankruptcy filing. Coughlin was receiving bribes from a Biglaw firm which specializes in Bankruptcy Law ... This same law firm received an extraordinary cash bonus authorized by a certain bankrupty Judge who "coincidentally" has a checkered history when it comes to bankruptcy misconduct. The "Honorable" Paul G. Hyman is a brilliant and trusting federal bankruptcy judge. Judge Hyman is trusting as he is willing to sign orders prepared by a bankruptcy lawyer who has the power to read his mind. That is to say, Judge Hyman need not make a finding of fact or a ruling, as is normal, prior to signing an order which is predicated on such a fact or ruling. Like when such order is prepared and filed by the same clairvoyant bankruptcy attorney without notice of the inclusion of content rendered via Paranormal Phenomena and/or corruption. A Conflict Of Interest exists whenever an entity (or person) holds some form of decision making power on behalf of another entity. Selfish interests on the part of the decision maker could corruptly influence the decisions to benefit the decision maker to the detriment of the entity which is represented. For example: beneficiaries are the creditors and stockholders of a bankrupt company, and the decision maker is the debtor's counsel or trustee. The simplest form of Conflict of Interest is when the decision maker must choose between outcomes that directly benefit himself over his beneficiary, and this type of direct conflict includes what is known as Agency Conflict. Direct personal conflicts are generally prohibited in most legal situations. Furthermore, they are easy to spot and difficult to hide. Thus, when corrupt decision makers seek to benefit themselves at the expense of their beneficiaries, they usually do so indirectly. For example, if a lawyer of a bankruptcy estate corruptly sold the primary asset of a debtor, such as a home or a building, to himself at an articifially low price it would be easy to spot and is explicitly prohibited. On the other hand, it would be much easier for a corrupt decision maker to sell a valuable asset at a reduced price to an associate. The associate would pay some form of bribe to the corrupt decision maker as quid pro quo for getting the asset(s) at a price lower than the beneficiaries would otherwise receive. There will be many angles to the Lewis Freeman story that will not be covered by BigMedia. There have been numerous cases of document fabrication in the claims resolution process, and the professionals who specialize in such work developed well tuned processes which enabled outrageous organized frauds upon the court by way of document fabrication without any risk of prosecution. Perhaps the most notable scheme was the "books and records" fabrication, whereby a lawfirm would swear that an anonymous corporate officer swore moneys were not owed to a particular creditor because the disputed amount was not reflected in the Debtor's "books and records". "Books And Records" Document Fabrication Scheme - A Delaware Specialty The stunning effectiveness of the "books and records" fabrication scheme is a result of the ease with which the corrupt Judges embraced the fraud upon them. While it is accurate to say that any lie before a court is a fraud upon the court, there was no money lost by the Court.
